Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country to consent to online services) to use Instamelo. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian who accepts these Terms on your behalf.

2. Your account

You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately at support@instamelo.com if you suspect unauthorized use. We recommend enabling two-factor authentication in your account settings.

3. The Service

Instamelo uses third-party AI models to generate music, lyrics, and related derivatives from prompts and inputs you provide. Output is generated by machine learning systems and may vary in quality, coherence, and originality. We do not guarantee that any specific output will be produced, or that similar prompts from different users will not produce similar results.

4. Acceptable use

You agree not to use the Service to:

• Generate content that infringes copyright, trademark, publicity, or other rights of any third party, including songs that imitate a specific identifiable artist’s voice or style without permission.
• Generate sexual content involving minors, non-consensual sexual content, or any other content that is illegal in the jurisdictions where it will be created or distributed.
• Harass, defame, threaten, or incite violence against any person or group; generate hate speech targeting protected characteristics.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Attempt to reverse-engineer, scrape, overload, or otherwise interfere with the Service or its underlying AI providers.
• Bypass or attempt to bypass authentication, rate limits, credit systems, or bot-detection measures.
• Use the Service to build or train a competing AI model.
• Resell, redistribute, or offer the Service to third parties except through account features we explicitly provide.
• Violate the terms of any third-party provider that powers the Service, including any AI generation, hosting, or communication provider.

We may suspend or terminate accounts that violate these rules, and we may remove or refuse to generate specific content without notice.

5. Content ownership and licensing

As between you and Instamelo, you retain ownership of the prompts, lyrics, and audio uploads you submit (“Inputs”), subject to the rights of any underlying third-party AI provider whose terms govern the generation pipeline.

You grant Instamelo a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process your Inputs and the resulting generated songs (“Outputs”) solely to operate, maintain, and improve the Service and to deliver the requested output to you.

Your rights to Outputs are subject to the terms of the AI provider that produced them. We make no representation that any Output is free of third-party rights or original in any legal sense. You are solely responsible for reviewing Outputs before publishing, distributing, or commercializing them.

6. AI-generated content disclaimer

Outputs are generated by machine learning models and can be inaccurate, unexpected, or offensive. Outputs are provided “as is,” and we do not warrant their fitness for any particular purpose. You must independently evaluate any Output before relying on it.

7. Billing and credits

Paid features and credit purchases are not currently available. When paid features launch, applicable prices, taxes, refund policies, and subscription terms will be presented at checkout and become part of these Terms upon purchase. Free credits or promotional balances have no cash value and may expire.

8. Third-party services

The Service integrates third-party providers listed in our Privacy Policy. Their terms may impose additional obligations on your use of generated content. We are not responsible for third-party outages, changes, or termination of service.

9. Termination

You may delete your account at any time from account settings, or by emailing support@instamelo.com. We may suspend or terminate your access if you materially breach these Terms or if we are required to do so by law. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND FREEDOM FROM DEFECTS OR INTERRUPTION. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL MEET YOUR REQUIREMENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTAMELO AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify and hold harmless Instamelo and its operators from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising from (a) your Inputs or Outputs, (b) your violation of these Terms, or (c) your violation of any third-party right, including intellectual-property rights.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update the “Last updated” date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms will be brought exclusively in the state or federal courts located in New Mexico, and you consent to the personal jurisdiction of those courts. This clause does not deprive consumers of the protection of the mandatory laws of their country of residence.
